2017 Arkansas Construction Legislation & Construction Law Update
AR. S.B. 601 Repeal the Arkansas Prevailing Wage Law repeals prevailing wage laws for public works projects. The legislature declared an emergency so that the bill would be effective before the end of the fiscal year on June 30, 2017.
AR. H.B. 2273 Develop a Construction Manager-General Contractor Method of Procurement for Transportation Projects creates the Construction Manager-General Contractor Method of Procurement Pilot Program. The goal is to develop a cost-effective procurement method for transportation projects since current revenues are inadequate to maintain infrastructure. The cost benefits are achieved by shifting liability for cost containment and project scheduling. It allows for 3 projects not to exceed a total of $200,000,000.
AR. H.B. 1645 Procurement Procedures for Municipal Sewage Systems clarifies the award procedure for municipal sewage systems. Using the design-build method, consideration includes qualifications and either the best value of capital or life cycle cost or both measures where appropriate. Using the general contractor construction management method, consideration includes qualifications and preconstruction phase services.
